What Is a T Visa?

A T Visa offers immigration protection to victims of human trafficking, allowing them to remain in the U.S. while assisting law enforcement in the investigation or prosecution of their traffickers. Human trafficking includes both labor and sex trafficking, often involving the use of fraud, coercion, or force.

T Visa holders can:

  • Remain in the U.S. for up to four years.
  • Obtain work authorization and access to certain federal and state benefits.
  • Apply for lawful permanent residency (Green Card) after three years or after the trafficking case concludes.

T Visa Eligibility Requirements:

  • You are or were a victim of labor or sex trafficking.
  • You are physically present in the U.S. or at a U.S. port of entry due to trafficking.
  • You have complied with reasonable requests for assistance from law enforcement (with some exceptions for minors or victims of trauma).
  • You would suffer extreme hardship involving unusual and severe harm if removed from the U.S.

Certain family members—including spouses, children, parents, and siblings—may also qualify for derivative T Visas, especially if they are at risk of retaliation due to the victim’s cooperation with law enforcement.

What Is a U Visa?

The U Visa is designed for victims of certain qualifying crimes who have suffered substantial physical or mental abuse and are willing to assist law enforcement in investigating or prosecuting those crimes.

U Visa holders may:

  • Receive work authorization.
  • Remain in the U.S. for up to four years.
  • Apply for a Green Card after maintaining continuous presence for three years.

Qualifying Crimes Include (but are not limited to):

  • Domestic violence
  • Sexual assault
  • Rape
  • Kidnapping
  • Human trafficking
  • Felony assault
  • Obstruction of justice or witness tampering
  • Fraud, extortion, or blackmail
  • Torture, incest, forced prostitution, and other related crimes

U Visa Eligibility Requirements:

  • You are a victim of a qualifying criminal offense that occurred in the U.S. or violated U.S. law.
  • You have suffered substantial physical or mental abuse as a result.
  • You have information about the crime.
  • You are or will be helpful to law enforcement or government officials in investigating or prosecuting the crime.
  • You are admissible to the U.S., or can request a waiver of inadmissibility by filing Form I-192.

Derivative U Visas are also available for certain qualifying family members. If you are under 21, you may include your parents and unmarried siblings under 18. If you are 21 or older, you may include your spouse and children.
